The Supreme Court split hairs and equivocated today on the issue of racial discrimination by American universities in favor of select racial groups. By a decision of 5-4 the Court decided to uphold the University of Michigan Law School’s discriminatory admissions policy that favors three ethnic groups in a nation which contains hundreds, and by a similar margin to strike down the discriminatory policies at the undergraduate level.

David Horowitz, President of the Center for the Study of Popular Culture and editor of FrontPagemagazine.com had this to say: “The Court’s reasoning was that the Law School’s policy was “narrowly tailored” to provide diversity. But why is diversity that includes three groups – African Americans, Hispanics and native Americans more important than a diversity that would include say, Vietnamese and Cambodian Americans, Jewish Americans, Sri Lankan Americans, Russian Americans, Irish Americans, Indonesian Americans, Rumanian Americans and others? The Court didn’t say.”

Horowitz , who is the author of Hating Whitey and Other Progressive Causes and a spokesman for Ward Connerly’s “Racial Privacy Initiative” said: “Diversity quotas – which is what the Michigan Law School policy amounts to – are in a practical sense no different than racial quotas. A clear-headed Supreme Court would have struck down the Law School preferences as well.”

The Individual Rights Foundation, an affiliate of the Center for the Study of Popular Culture has filed a friend of the court brief in this case and David Horowitz has written extensively on the issue of Affirmative Action and race relations.
